Opus provides business consulting and related advisory services—such as operational improvement, process and workflow analysis, data visibility, and practical recommendations to help organizations reduce waste and make better decisions. Descriptions, case-style examples, and illustrations on this site (including sample dashboards or metrics) are for general informational and marketing purposes.

Use of this website does not create a consulting, agency, partnership, or employment relationship. A separate written agreement (for example, a proposal, statement of work, or services agreement) is required before we owe you professional duties or deliverables.

TO THE FULLEST EXTENT PERMITTED BY LAW, OPUS AND OUR OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US SPECIFICALLY FOR ACCESS TO THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (TYPICALLY ZERO FOR BROWSING), OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE PROHIBITED BY LAW.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Indemnity

To the extent permitted by law, you will defend and indemnify Opus and our affiliates against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the site, your violation of these Terms, or your violation of third-party rights.

Governing law; disputes

These Terms are governed by the laws of the United States and the laws of the state in which Opus Business Consulting primarily operates, without regard to conflict-of-law principles that would apply another jurisdiction’s laws. You agree that exclusive jurisdiction and venue for any dispute arising out of these Terms or the site will lie in the state and federal courts located in that state, unless applicable law requires otherwise.

Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use of the site after changes become effective constitutes acceptance of the revised Terms. If changes are material, we will provide additional notice where appropriate.

General

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding your use of the site (separate written agreements govern paid engagements).
